Vadistanbul Avm Hizmetleri Anonim Şirketi (hereinafter ‘Vadistanbul’ or the ‘Company’) makes best efforts in order to ensure protection of personal data of all real persons with whom the Company contacts in any manner and to fulfil all requirements of the Personal Data Protection Law no. 6698 (hereinafter ‘PDPL’ or the ‘Law’) while performing its commercial activities ever since the Law entered into force.

This Personal Data Protection and Non-Disclosure Policy (the ‘Policy’) is issued to provide information about the processes and principles governing the collection, utilization, disclosure, transfer and storage of personal data by Vadistanbul. This Policy elaborates the principles adopted by Vadistanbul for processing personal data of data subjects in line with the provisions of the PDPL. Vadistanbul remains dedicated to processing personal data in line with the principles and processes provided in the PDPL and other applicable regulations. In that respect, Vadistanbul observes the following principles of the PDPL while processing personal data:

Transcripts, diplomas and certificates including educational information of the data subjects, records of professional experience and letters of reference, and personnel information such as salary, social security, payroll and performance evaluation records.

Financial Information

All kinds of financial information, documentation and records arising from the legal relationship between Vadistanbul and data subject as well as personal data such as bank account number, IBAN number and credit card information.

Image and Voice Details

Information desk, call centre calls, CCTV footage and voice records of physical spaces.

Contact Details

Telephone number, address, e-mail address, facsimile number and similar information.

Information about Lost and Found Items

Information available on the forms completed for lost and found items in Vadistanbul Shopping Mall.

Identity Details

Identity details provided in ID cards, driving licenses, passports and similar documents such as full name, Turkish ID number, nationality, mother’s name, father’s name, place of birth, date of birth, gender, signature, military service details and domicile address.

Tenant Information

Store name, brand, company title, head office contact details, and identity and communication details of contact persons of the relevant store/company.

Location Information

Approximate location data of the data subjects whose data are collected automatically on the website and mobile applications.

Special Categories of Personal Data

Health data including blood type, biometric data, religion and memberships to associations, criminal record, biometric photo and documents containing disciplinary details as provided in article 6 of the PDPL.

Marketing Information

Information obtained through surveys, draws, campaigns and direct marketing activities conducted by Vadistanbul.

Request, Complaint, Opinion and Evaluation Details

Information provided in the forms and call centre records containing the requests, complaints, opinions and evaluations of data subjects.

 

 

  1. CONDITIONS FOR PROCESSING PERSONAL DATA

Explicit consent of data subjects is one of the legal prerequisites in order to process personal data in a legitimate manner. Where explicit consent is not provided, personal data may be processed in case of availability of the following conditions provided in the Law. Hence, Vadistanbul may undertake personal data processing activities to the extent that:

  • It is explicitly provided in the laws,
  • It is not possible to obtain explicit consent from the data subject owing to actual obstacles,
  • It is necessary to process the personal data of the parties to a contract provided that any such processing shall be directly related to the execution or performance of the contract,
  • It is essential for Vadistanbul to fulfil its legal obligations,
  • The personal data have already been made available to public by the data subject,
  • Processing of personal data is required for creation, use or protection of any right,
  • The relevant processing is required for legitimate interests of the data controller provided that the fundamental rights and freedoms of the data subject are not impaired.

Conditions for Processing Special Categories of Personal Data

Vadistanbul takes utmost care in processing special categories of personal data since they are of critical importance for protection of data subjects. Accordingly, in the absence of explicit consent of a respective data subject, Vadistanbul may only process: (i) special categories of personal data other than health condition and sexual life of the data subject under the conditions specified in the laws, (ii) special categories of personal data related to the health condition and sexual life of the data subject only by means of persons who are under non-disclosure obligation or competent authorities and institutions for the purpose of protecting public health, applying preventive medicine, performing medical diagnosis, treatment and care services, and planning and administering healthcare services and funding provided that the adequate precautions to be designated by the Board shall be duly adopted in both cases.

 

  1. PURPOSES OF PROCESSING PERSONAL DATA

Vadistanbul shall process personal data based on the following purposes which may be updated from time to time in line with the corporate policies and legal obligations:

  • Performance of human resources operations by Vadistanbul in line with human resources policies,
  • Performance of services by Vadistanbul in order to ensure that the relevant services could be executed by the relevant business units,
  • Performance of administrative operations in order to promote the legal and commercial safety of persons who have a business relationship with Vadistanbul,
  • Performance of financial operations, communication activities, and processes and operation in order to determine and implement the commercial and business strategies of Vadistanbul,
  • Determination and implementation of commercial and business strategies of Vadistanbul, ensuring internal system and application management,
  • Planning, auditing and executing information security processes, ensuring creation and management of IT infrastructure,
  • Planning and executing employee satisfaction and/or commitment processes, employee benefits and employee’s information access authorization levels, conducting follow-up and/or supervision of business activities of employees,
  • Planning and executing sales, marketing and/or launching activities for business operations and services,
  • Planning and executing information access authorization levels for business partners and/or suppliers, management of relationships with business partners and/or suppliers,
  • Planning and executing corporate communication activities and corporate management activities,
  • Planning and executing customer relations management processes, planning and/or monitoring customer satisfaction processes, monitoring customer requests and/or complaints,
  • Fulfilling obligations regarding corporate employees arising from employment contracts and/or applicable regulations,
  • Ensuring safety of corporate equipment and/or resources,
  • Planning external training activities,
  • Planning and executing operational activities required for conducting corporate activities in line with the internal procedures and/or applicable regulations,
  • Ensuring the data are correct and up-to-date,
  • Providing information to competent individuals and/or institutions in line with the applicable regulations,
  • Creating and monitoring visitor records and promoting safety at the head office and facilities of the company,
  • Performing activities in order to offer products and services of Vadistanbul to the benefit of individuals.

The aforementioned categories are provided for informational purposes in that Vadistanbul reserves the right to introduce other categories in order to facilitate its commercial and other relevant operations in the future. In such cases, Vadistanbul shall update the relevant categories in this text as necessary in order to continue providing information to you as promptly as possible.

 

  1. STORAGE OF PERSONAL DATA

Vadistanbul stores the personal data safely in physical or electronic media for a suitable period in order to perform its commercial operations. In that respect, Vadistanbul complies with all of the obligations indicated in the applicable regulations including the PDPL with respect to protection of personal data. Pursuant to the relevant regulations, Vadistanbul shall delete, remove or anonymize the personal data either on its own or upon the request of data subjects by means the application form or otherwise as soon as the relevant processing purposes are duly fulfilled without prejudice to conditions allowing or requiring longer retention of personal data. If the personal data are deleted with the use of the relevant methods, these data shall be destroyed in a manner to render them unusable and irrecoverable in any manner.

Nevertheless, where required for protecting the legitimate interests of the data controller, personal data may be stored until the conclusion of the general prescription period provided in the Obligations Code (ten years) notwithstanding the expiration of the period specified in the applicable laws and conclusion of the processing purpose provided that the fundamental rights and freedoms of data subjects shall not be impaired. After the relevant prescription period, personal data shall be deleted, removed or anonymized according to the procedure indicated above.

 

  1. TRANSFER OF PERSONAL DATA TO DOMESTIC THIRD PARTIES

Vadistanbul diligently observes the conditions of the PDPL in addition to the provisions of other applicable laws in relation to disclosure of personal data to third parties. In that respect, Vadistanbul does not transfer personal data to third persons without explicit consent of the data subject. Still, pursuant to the provisions of the PDPL, Vadistanbul may transfer personal data without explicit consent of the data subject to the extent that:

  • It is explicitly provided in the laws,
  • It is essential for safekeeping the life or physical integrity of the data subject or a third person in the event that the data subject is unable to utter explicit consent owing to actual obstacles or else the explicit consent provided by the data subject is not deemed legally valid,
  • It is necessary to process the personal data of the parties to a contract provided that any such processing shall be directly related to the execution or performance of the contract,
  • It is essential for the data controller to fulfil its legal obligations,
  • The data subject has already made the data available to public,
  • Processing of personal data is required for creation, use or protection of any right,
  • The relevant processing is required for legitimate interests of the data controller provided that the fundamental rights and freedoms of the data subject are not impaired.

It shall be possible to transfer special categories of personal data other than health conditions and sexual life if provided in the applicable laws while special categories of personal data related to health conditions and sexual life can be transferred for the purpose of (a) Protection of public health, (b) Preventive medicine, (c) Medical diagnosis, (d) Treatment and medical care services, (e) Planning and management of healthcare services and funding etc. without obtaining explicit consent by taking adequate precautions.

The conditions provided for processing of special categories of personal data shall also be applicable for the transfer of any such data.

 

  1. TRANSFER OF PERSONAL DATA TO THIRD PARTIES ABROAD

Data subjects are required to provide explicit consent for transfer of personal data abroad in line with article 9 of the PDPL. Nevertheless, Vadistanbul may transfer personal data, including special categories of personal data, abroad without obtaining explicit consent from data subjects in case of conditions allowing for processing of personal data without such explicit consent provided that the foreign country where the personal data shall be exported should have sufficient measures for protection of personal data. If the country where the personal data are to be exported is not deemed to be among the countries with sufficient protection by the Board, Vadistanbul and the data controller/data processor in the relevant country shall undertake to ensure sufficient protection in writing.  

 

  1. DATA SUBJECT RIGHTS

Vadistanbul shall ensure that data subjects shall be able to exercise the rights indicated in article 11 of the PDPL with respect to the personal data processed in line with the principles specified herein. In that respect, data subjects shall be entitled to:

  • learn whether or not their personal data have been processed,
  • request information about the processing, if any,
  • request information about the processing purpose and whether or not the use of the data is fit for the purpose,
  • receive information about the recipient domestic or foreign third parties,
  • ask for correction in case of incomplete / incorrect processing and also demand notification of the relevant process to the third persons who are known to have received the personal data by way of transfer,
  • request deletion, destruction or anonymization of personal data once the processing purpose is fulfilled even though the processing has been performed in line with PDPL and other legal provisions and also demand notification of the relevant process to the third persons who are known to have received the personal data by way of transfer,
  • object to any unfavourable result for the data subject arising from analysis of processed data with automated systems exclusively,
  • demand indemnification against losses, if any, incurred as a result of processing activities in violation of the law.

Data subjects may exercise the abovementioned rights by submitting a copy of the duly signed application form attached to this Policy to the contact addresses of Vadistanbul by mail, e-mail or registered letter. The application form contains information about completion and submission of the form to Vadistanbul. Upon receiving any such form, Vadistanbul shall convey its response to the data subject filing the application physically or in electronic media.

Vadistanbul shall conclude the requests of data subjects free of charge as soon as possible not to be later than thirty (30) days according to the attributes of the request. Still, if any such request requires an additional cost, Vadistanbul shall charge the relevant cost to the relevant person based on the tariff specified by the PDPL Board. Besides, Vadistanbul may demand data subjects to submit additional information or documentation for concluding relevant responses.

 

  1. PRECAUTIONS FOR DATA SECURITY

Vadistanbul is dedicated to taking all kinds of technical and administrative measures required for ensuring suitable security level for protecting personal data. Vadistanbul shall take the following measures in order to (a) prevent unlawful processing of personal data, (b) prevent unlawful access to personal data, and (c) ensure safekeeping of personal data:

  • Vadistanbul shall conduct or have third parties conduct audits at its own organization in order to ensure implementation of the provisions of the Law.
  • Vadistanbul shall immediately inform the data subject and the Board in the event that any processed personal data are acquired by third parties through unlawful methods.
  • Vadistanbul shall execute a framework agreement with the persons to whom personal data are disclosed or else incorporate additional provisions to existing agreements with a view to promoting data security.
  • Vadistanbul shall recruit employees with sufficient knowledge and experience about processing personal data and offer required Personal Data Protection training to its employees.

  • It shall conduct internal controls required for the available systems.
  • It shall procure technical infrastructure to monitor and/or prevent unauthorized access to personal data.
  • It shall ensure that data access authorization of employees assigned in IT division is duly kept under control.

 

  1. PROCESSING CCTV FOOTAGE

Vadistanbul records CCTV footage of the visitors, employees and other relevant persons in line with the fundamental principles of the PDPL and this Policy in order to promote the commercial and overall security of the facilities and enterprises. Vadistanbul keeps the CCTV footage safely in physical or electronic media throughout the period specified for the processing purposes.

Notices are visibly displayed where CCTV footage is taken in order to duly inform the data subjects. In that regard, Vadistanbul shall comply with all kinds of legal requirements, including specifically PDPL, with respect to protection of personal data. CCTV system shall not be available in areas requiring high degree of privacy.

 

  1. EFFECTIVE DATE AND REVISION

This Policy shall become effective on the date of publication. Vadistanbul shall have discretion to make amendments to this Policy, including abolition of the Policy, and determine principles of implementation.

Rules of implementation shall be determined by means of a regulation to be issued under this Policy in order to elaborate the implementation of the matters provided herein for specific conditions.
